Wildfennel Tattoo – Luz, Portugal

A. Eligibility and Right to Refuse Service
(1)
Wildfennel Tattoo provides tattoo services exclusively to persons who are at least 18 years of age.
(2)
Wildfennel Tattoo will not provide tattoo services to persons who:
- are under the influence of alcohol and/or drugs;
- are in an unstable mental or physical condition;
- are pregnant or breastfeeding;
- have taken blood-thinning medication;
- suffer from an immune deficiency disorder and/or haemophilia;
- suffer from a contagious illness, infection, or skin condition that may affect the tattooing process or healing.
(3)
Wildfennel Tattoo reserves the right to refuse any tattoo request:
- if the requested design is considered offensive, discriminatory, extremist, or otherwise contrary to the values of Wildfennel Tattoo;
- if there are health, safety, ethical, or other concerns that make the tattoo unsuitable.
(4)
The client is responsible for providing complete, accurate, and truthful information regarding their health condition and any other circumstances relevant to the tattoo procedure.
B. Deposit and Cancellation Policy
(1)
A deposit is required when booking an appointment. Deposits must be paid via bank transfer or PayPal unless otherwise agreed.
(2)
The deposit amount is:
- €50.00 for smaller tattoos;
- €100.00 for larger or more complex tattoo projects (full-day appointments).
Deposits are non-refundable.
Exceptions may be granted at the sole discretion of Wildfennel Tattoo in the form of a voucher if:
- the appointment cannot be attended for medical reasons (medical certificate required);
- the appointment cannot be attended due to relocation to a location more than 300 km away (proof of address required).
The deposit covers both the reservation of the appointment and the preparation of the custom tattoo design. The deposit will be deducted from the final tattoo price.
(3)
The deposit will be forfeited in full if:
- the client fails to attend the appointment without prior notice;
- the appointment is cancelled less than three business days before the scheduled date;
- the tattoo cannot proceed due to circumstances described in Section A.
(4)
Wildfennel Tattoo reserves the right to cancel or reschedule appointments if necessary.
In such cases, the deposit remains valid and may be transferred to a new appointment date.
Wildfennel Tattoo shall not be liable for any travel expenses, accommodation costs, cancellation fees, lost bookings, or other expenses incurred by the client as a result of a cancelled or rescheduled appointment.
(5)
Wildfennel Tattoo reserves the right to allocate appointments according to the requested design and to cancel or amend appointments if the tattoo concept is substantially changed after the booking has been confirmed.
C. Prices and Payment
(1)
Tattoo prices are based on size, complexity, placement, and the estimated time required.
The minimum charge is €100.00.
Projects completed in a single session are charged at a fixed rate according to complexity and workload. Larger projects requiring multiple sessions are charged according to the previously agreed session or hourly rate.
(2)
Prices include one complimentary touch-up session, which must be booked within six months of the completion date of the tattoo.
The complimentary touch-up does not apply where fading, damage, or healing issues result from improper aftercare, excessive sun exposure, swimming, picking, scratching, or any other factors outside the control of Wildfennel Tattoo.
(3)
Payment is due immediately after each session and must be paid in full using one of the accepted payment methods available at the studio.
D. Disclaimer of Liability
(1)
By proceeding with the tattoo appointment, the client acknowledges and accepts the inherent risks associated with tattooing.
Wildfennel Tattoo accepts no liability for:
- complications resulting from failure to follow aftercare instructions;
- allergic reactions or unforeseen medical complications that were not disclosed by the client;
- dissatisfaction with the artistic style, placement, size, or appearance of the tattoo once approved by the client;
- spelling, grammar, date, or translation errors in the design after final approval by the client;
- normal variations in healing, colour retention, or skin response.
(2)
The client must immediately notify Wildfennel Tattoo of any unusual healing issues, infections, or adverse reactions following the tattoo procedure.
E. Consent to Physical Contact
(1)
The tattoo process requires physical contact with the client’s skin and body in the area being tattooed.
The client expressly consents to such contact, which is necessary for the provision of tattoo services. Such contact shall not be interpreted as inappropriate conduct and forms an essential part of the tattooing procedure.
F. Data Protection and Use of Images
(1)
All personal data collected by Wildfennel Tattoo shall be processed confidentially and in accordance with applicable data protection legislation, including the European Union General Data Protection Regulation (GDPR).
(2)
Personal data will be used solely for purposes related to appointment management, legal obligations, health and safety requirements, and communication with the client.
(3)
Photographs of completed tattoos may be taken for portfolio, website, and social media purposes.
Such photographs will only be published with the client’s consent.
(4)
Wildfennel Tattoo accepts no responsibility for unauthorised copying, sharing, reproduction, or misuse of published images by third parties.
G. Governing Law
(1)
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of Portugal.
(2)
Should any provision of these Terms and Conditions be found invalid or unenforceable, the remaining provisions shall remain unaffected and continue in full force and effect.
